UK2NUMBERS STANDARD COMMERCIAL TERMS AND CONDITIONS FOR THE PROVISION OF TELECOMMUNICATIONS SERVICES


We endeavour to make our Terms and Conditions as easy as possible to read. If there is any aspect you require clarification on please do not hesitate to contact us.


1 General:

1.1 UK2Numbers operates a unique, Customer friendly policy where there is no minimum or maximum period of Contract duration and a Customer may enter and exit this Contract and cancel a number at any time providing that all charges duly owed to UK2Numbers and incurred by the Customer during whatever the length of Contract might be, are fully paid in accordance with this Agreement.

1.2 Routing is usually activated within 10 minutes of a Customer Order, subject to their Credit Card being authorised. Allow 24 hours for us to process your application.

1.3 These Terms and Conditions constitute the entire Agreement between the Parties with respect to its subject matter and shall supersede any previous Agreement.

1.4 The Customer acknowledges that they have not been induced to enter this Agreement by any representation, warranty or other assurance not expressly incorporated into it.

1.5 By ordering Services and / or purchasing a product supplied by UK2Numbers, the Customer agrees to accept and adhere to the Terms and Conditions as set out in this Agreement.

1.6 Where more than one person constitutes the Customer, liability shall be joint and several.

1.7 An entity or a person who is not a party to this Contract has no right under the Contract to enforce any term of this Agreement (Right of Third Parties Act 1999), bar the rights and remedies available to a third party outside the scope of the said Act.

1.8 All communications between the Customer and UK2Numbers shall be by way of email, except when it is expressly indicated, requested or required otherwise at UK2Numbers’ discretion.

1.9 Any documents shall be forwarded / exchanged by the parties to this Agreement by way of email, unless where it is expressly indicated, requested or required otherwise by law or at UK2Numbers’ discretion as in an instance where sight of a copy of an original document is required for the purpose of verification which may assist us in facilitating your request for Services.

1.10 All notices, issued by either Party shall be forwarded / served by way of email, unless where it is expressly indicated, requested or required otherwise by law and / or UK2Numbers’ discretion.

1.11 Any changes in Tariffs, Charges, Rates and Product Prices shall be publicised on the UK2Numbers website.

1.12 All bills / invoices by either Party shall be submitted by way of email, unless where it is expressly indicated, requested or required otherwise by regulations or at UK2Numbers’ discretion.

1.13 In instances where it is expressly required by law or other relevant authority, all items described in clauses 1.9, 1.10 and 1.12 may be served / sent to the addresses of the Parties to this Agreement.

1.14 The Customer’s address, be it residential, a Registered Office, or any other address provided by them on the Order Form, shall be deemed valid for the purposes itemised in clause 1.13.

1.15 In cases when the Customer changes their address using the protected online facility, their file will be instantaneously updated and that address shall be held valid and current and used for the purposes referred to in clause 1.13.

1.16 In instances itemised under clause 1.13 the Customer should use the UK2Numbers address, as indicated in this Agreement under clause 9.31.

1.17 All items listed in clauses 1.9, 1.10, 1.11, 1.12 shall be deemed served 48 hours from the postal date, bar those despatched by facsimile or email, in which instance their service shall be affected after 12 hours in the former and immediately in the latter case.

1.18 Occasionally UK2Numbers may be required by an Authority such as OFCOM, ICSTIS, Operator legislation or any other valid reason, to vary these Terms and Conditions and any such alteration shall be publicised on our website.

1.19 Any concession granted by UK2Numbers to the Customer should be treated as an isolated event, it will not constitute a waiver or forfeiture of the Customer’s obligations under this Agreement and UK2Numbers shall not be prejudiced or prevented by actioning their rights.

1.20 No express or implied waiver by UK2Numbers shall be treated by the Customer as continuous and the Customer is obliged to comply with the Terms and Conditions at all times.

1.21 Any and all matters pursuant to this Agreement are governed by English Law and are under exclusive jurisdiction of the English Courts.

1.22 Should any part of this Agreement be deemed unenforceable by English Courts or another relevant and competent authority, the enforceability of its remainder shall remain unaffected.

1.23 UK2Numbers omission to exercise enforcement of any of its rights expressly set in this Agreement should not be construed by the Customer as a waiver or forfeiture of them and UK2Numbers retains the right to act upon them and / or any other subsequent breach of the Agreement.

2 Provision of Services:

2.1 UK2Numbers provides Services to the Customer in accordance with this Agreement and any other instructions we may specify in a Customer Guide once a Customer has placed an Order and UK2Numbers has accepted it.

2.2 UK2Numbers provides NGN ranges and accepts UK Landline Numbers, UK Mobile Numbers, International Landlines, International Mobile Numbers and email addresses as your choice of Termination Point for delivery of telephone and Fax2email communications.

2.3 UK2Numbers provides Personal Numbering Service with 070 ranges and accepts any Landline and Mobile Telephone Number in the UK or Internationally, and email addresses as the Termination Point for delivery of telephone and fax2email communications.

2.4 Provision of different and / or specific Services by UK2Numbers to the same Customer may be treated as a separate agreement on the same terms and conditions, which shall continue to apply to any new and remaining services, unless UK2Numbers advises the Customer to the contrary.

2.5 UK2Numbers may select and change any carrier for the purpose of provision of Services to a Customers and at any time assign this Agreement or the benefit and / or burden thereof in part or in whole to any third party. Reference in these terms and conditions shall be deemed to cover a reference to its assigns.

2.6 UK2Numbers shall act on your behalf in dealings with any Third Party Operator in any matter that is pertinent to the provision of Services to our Customers.

2.7 UK2Numbers may need, when appropriate, to undertake improvements to Services and shall always endeavour not to change or alter the nature of the Services.

2.8 UK2Numbers may, from time to time, carry out preventative or remedial operations and shall always attempt to keep such occasions to minimum inconvenience, if any, to the Customer.

2.9 UK2Numbers may vary and / or amend any of the Terms and Conditions of this Agreement whenever it is reasonably necessary and with valid reasons which may be, but not limited to, legal, regulatory or business requirements and such variation(s) and / or amendment(s) shall be publicised on our web pages and notified to the Customer in an approved manner as defined in Section 1.

2.10 The content of our web site is subject to change without notice.

3 Customer’s Acknowledgement:

3.1 Unless otherwise specified, your existing line supplier will continue to provide you with Network Access and any associated services. Payment of all charges incurred in that respect will remain your responsibility and you must continue paying them in a timely manner to enable us to deliver uninterrupted Services to you. Your failure to maintain your account in order with your Network Access Provider shall release UK2Numbers of any responsibility from potential consequences arising from such situation resulting in interruption of our Services to you.

3.2 During the entire duration of our provision of Services to you by UK2Numbers you authorize us to act on your behalf in any and all situations defined in clauses 2.5 and 2.6 in order to secure delivery of undisrupted Services to you.

3.3 Any software used by UK2Numbers in connection with our Services which contains proprietary and confidential information is subject to copyright, intellectual and trademark laws and it is prohibited to copy, modify, or exploit in part or in whole neither the software nor the Services.

3.4 Ultimate ownership of: 01, 02, 03, 070, 0800, 0844, 0845, 0870, 0871 and all other numbers from any range rests with OFCOM, not a telecom provider or the Customer as end user and shall remain as such at all material times.

3.5 The 070 number range is part of a Personal Numbering Service which is defined as a service “based on number translation that enables end users to be called or otherwise contacted using a single, Personal Telephone Number and to receive those calls or other communications at almost any Telephone Number including Mobile Numbers”. A Personal Number is also defined in the plan as a Telephone Number “assigned by a Personal Numbering Service Provider, which allows a Subscriber to receive calls or other communications at almost any Telephone Number, including a Mobile Number.”

3.6 The Personal Numbering Service with its 070 range offers a variety of uses benefiting the person being called and is particularly suitable for (i) customers who habitually move location, but this is not a requirement or prohibition, (ii) users of Internet chat rooms, who wish to talk to new acquaintances, without divulging their private landline or mobile telephone number, (iii) solely for the purpose of selling through a magazine, e.g. cars or household items, (iv) to patients in hospitals where the use of mobile phones is restricted and where, by allocation of a 070 Personal Number they can still be contactable for the duration of their stay.

3.7 UK2Numbers Personal Numbering Service 070 range does not attract any revenue payable to End-Users and must be used in compliance with clauses 4.8 and 4.10.

4 Customer Code of Conduct:

4.1 You must ensure that Number(s) and associated Services supplied to you are in operation by simple self test as defined in clause 9.24, before announcing, advertising or publicising the numbers assigned to you.

4.2 You must endeavour to respond to any administrative requirement from UK2Numbers in a timely manner, as it can be of the essence for satisfactory provision of Services and maintenance of your Account.

4.3 You must ensure that your User Name, Password and any PIN number for accessing your Account and the Services are kept safe at all times and not disclosed to others as they are confidential to you. Please note that the correct quotation of your User Name, Password and PIN Number may result in your Account and Services being accessed by unauthorized person(s). Therefore responsibility for their safe keeping rests with you. You agree that UK2Numbers may act on the instructions of and disclose any information in connection with your account(s) to anyone who correctly quotes your username and password.

4.4 You may not transfer obligations under this Agreement nor can you assign its rights or benefits in part or in whole unless UK2Numbers is required to permit so, pursuant to relevant laws and regulations.

4.5 If you want to transfer your services and number to someone else, you must, as well as any general requirements in this contract:
a) use our current transfer process; and
b) make sure that the person taking over the services and number accepts Terms and Conditions of this agreement in full.

4.6 You must not use the Service, nor allow others to use it in such manner that may cause damage to the property, harm or injury to any person(s) whether employees, representatives or agents of UK2Numbers.

4.7 You must not use the Services in any manner which may jeopardise its operation and quality, nor cause damage to any part of telecommunications equipment which facilitate the delivery of the Services.

4.8 You must not act in any way which may amount to abuse of the Services.

4.9 You must ensure that the Services or any Number Range are not used for any of the following: (i) improper, (ii) immoral, (iii) unlawful purposes.

4.10 You must ensure that 070 Personal Numbers Range is used in accordance with this agreement.

4.11 You must ensure that the Services are not used for transmission of any communication which is abusive, defamatory, hoax, indecent, malicious, obscene, racially or otherwise offensive, or threatening.

4.12 You must ensure that the Service is not used in any way which may cause anxiety, harm, harassment, inconvenience or any other violation of a person’s rights.

4.13 If you permit the Service provided to you to be used by others you must ensure that they do it in compliance with this Agreement.

4.14 Should the Customer discover that someone else and without their explicit permission has used the Services in any manner which contravenes the Customer Code of Conduct, you are obliged to contact UK2Numbers and the Police in case of breaches of clauses 4.9 - 4.12 inclusively. It is in the interest of all Parties that this is done as soon as possible.

4.15 Failure by the Customer, or any other person(s) authorised by them to use the Services, to comply with clauses under the Section “Customer Code of Conduct” shall be deemed a breach of the Agreement and UK2Numbers shall hold you responsible for any claims, losses, damages, costs (including legal expenses), and we shall seek that you indemnify us for consequences we may suffer as a result of any such breach.

5 Charges and Payments:

5.1 Rental Charges shall be payable pro-rata monthly, in advance, unless stated otherwise and shall be due from the Commencement Date. Invoices for the Rental and Connection Charges, shall be issued by UK2Numbers following the Commencement Date.

5.2 Call Charges shall be payable monthly in arrears, unless your costs reach a certain threshold within the monthly billing cycle or unless otherwise indicated in the Agreement. The billing threshold is variable and is assessed by our system daily, based on your current call volume, previous payment history and your credit rating. Call Charges shall be calculated by reference to UK2Numbers Usage Data. Invoices shall be provided on-line.

5.3 Calls which attract charges to the Customer have £0.05 minimum call charge and are billed by the second or minute equivalent for call plans with inclusive minutes, and include: (i) 01, 02, 03, 0870, 0800 numbers, (ii) diversions to mobiles in the UK, (iii) diversions to International Landline or Mobile numbers, (iv) diversions to any NGN and Premium Rate Numbers. These charges shall be payable monthly in arrears, and valid credit or debit card must be on file at all times, unless otherwise indicated in the Agreement. Chargeable Freefone 0800 calls originated from BT Public Payphones or Operator Assisted calls will incur an additional £0.25 per minute BT Levy Charge which will be charged to the Customer separately and in addition to standard 0800 rate.

5.4 Where any payments are properly due to the Customer, following the implementation of any Reward Programme operated by UK2Numbers, they will be paid to the Customer during the billing cycle in which an initial amount of £100 has been earned, if the Customer is not required to raise a VAT invoice against UK2Numbers. If the Customer is required to raise a VAT invoice against UK2Numbers, the minimum amount will be £300, payable within 28 days of receiving an invoice. Thereafter, the minimum monthly payment will be £100 (without VAT invoice) or £300 (with VAT invoice). If the amount outstanding to the Customer at the end of each month is less than these specified amounts, payment will be rolled over to the following month. If, by the end of a 12 month period following the last payment or initial setup if no payments have been made, the amount due is still below these amounts and above £10, the outstanding amount will be paid to the Customer. If the specified amounts are not reached on Termination of Services, by breach or otherwise, the accrued sum shall be forfeited.

5.5 Notwithstanding Clauses 5.1 and 5.2, UK2Numbers may at their discretion seek a deposit from the Customer in respect of any of the Charges or prior to, and as a condition of, delivery or installation of the On-Site Equipment and / or the commencement of Services, such as 01, 02, 03, 07, 08 Diversions, Routing to a Mobile or Landline.

5.6 Any deposit taken for the purpose as defined in 5.5 above is returnable and will be due to the Customer on cessation of this Agreement providing that at the time of its termination their Account is settled in full. Any outstanding Charges due to UK2Numbers at that point shall be accordingly deducted. If termination is caused by Customer’s breach of any of the terms set out in this Agreement, any cost, loss or liability we may be exposed to following such termination shall be met from deposit paid.

5.7 All amounts payable are exclusive of Value Added Tax (VAT) or any applicable taxes, which may from time to time be levied and as such shall be indicated as a separate item in addition to and at the same time as any charges on all invoices issued to the Customer.

5.8 The Customer is obliged to pay all UK2Numbers charges for the Services as submitted by way of Invoice which will be issued in accordance with the relevant terms and rules, charges and tariffs applicable at the time of usage.

5.9 All payments due to UK2Numbers hereunder become payable immediately on issue of the relevant invoice and must be paid in full, without any withholding, set-off or deduction of sums which may be due from UK2Numbers to the Customer.

5.10 In accordance with the Late Payment of Commercial Debts (Interest) Act 1998 as Amended in August 2002, late payments shall attract interest which continues to accrue daily on the outstanding amount until a debt is fully settled. The Annual Rate applied to late payments is 8% per annum above the Bank of England Base Rate as current at the time of the delayed payment. UK2Numbers shall also be entitled to the fixed compensation sum which is variable and dependant on the size of the debt.

5.11 UK2Numbers may, from time to time, review and vary, if deemed necessary, the Rates and Charges related to Services and any UK Taxes applicable, if so imposed on us. Any such change shall take place only with valid reason such as, but not limited to, a change in our arrangements with a Third Party Operator, changes in regulatory and legal requirements imposed on us, or other reasonable business demands. Any such change shall be publicised on our website and notified to the Customer in an approved manner as defined in 1.10, 1.11.

5.12 At UK2Numbers discretion, for numbers provided free of charge or without minimum contract terms, porting applications may be subject to an administration charge of £149.95 per number.

6 Suspension of Services:

6.1 UK2Numbers may suspend and / or disconnect Services, void any rebate payments and / or terminate this Agreement by giving you prior, written notice in a way as set out in 1.10 :

a. If we are unable to supply or provide the Services, for any reason beyond our control, including acts of God, Government, severe atmospheric conditions, emergency on a major scale or any social disturbance of extreme nature such as industrial strike, riot, terrorism and war, any act or omission of any provider, such as a Network Access Provider, Network Operator or their telecommunication systems, their loss of revenue or receivership.
b. If the Customer breaches any clause of the Terms and Conditions, of this or any other Agreement they may have with UK2Numbers or its corporate bodies.
c. If the Customer fails to respond to our request for provision of documentation to verify their details within 5 working days.
d. If the Customer is not contactable at their notified address, email address or telephone number.
e. If the Customer fails a credit and fraud prevention check referred to in Section 8 or we have sufficiently good reason to suspect money laundering.
f. If UK2Numbers have valid reasons in believing that any information the Customer has provided us with on the opening of an account or during the provision of Services is false or misleading.
g. If UK2Numbers forms a view, based on information provided by you or any credit provider or Credit Reference Agency, that you may not be willing or able to meet your obligations in relation to payment for our Services.
h. If the Customer becomes, or, in UK2Numbers reasonable opinion, is likely to become insolvent or, if in the case of an individual, on death, or filing for bankruptcy or individual voluntary arrangement, in the case of a partnership, on dissolution or filing of an application for dissolution, or in the case of a company, in administration, receivership, liquidation, voluntary arrangement, insolvency, under proposal to strike-off, on filing of an application for winding up or appointment of an administrator, receiver or practitioner.
i. If the Customer exceeds a credit limit imposed by UK2Numbers or fails to make a payment, or if call or account charges incurred by you exceed the value of any security deposit held on your account.
j. If the Customer fails to pay any Charges or if a valid credit or debit card is not kept on the account at all times.
k. If the Customer does not remedy the breach for which suspension and disconnection were imposed.
l. In the case of a Non-Geographic Number (NGN) or Personal Number receiving less than 3 minutes per month of incoming calls after the first 60 days of operation, UK2Numbers may reclassify the Number as a Low Usage Number and we may apply a Low Usage Charge of £4.95 per month until such time as usage exceeds 3 minutes per month.
m. If otherwise reasonable or necessary.

6.2 Number(s) issued to Customers shall be withdrawn on: (i) termination resulting from a breach of the Agreement and (ii) at the end of the Agreement resulting from any other reason.

6.3 All Charges outstanding at the Agreement termination become payable on demand immediately.

7 Damages – Limitation of Liability:

7.1 UK2Numbers aims to continuously demonstrate their lasting commitment to Customers by applying at all times reasonable skill and care in provision of the Services and we shall not exclude or limit any liability that by law cannot be excluded or limited.

7.2 We shall not be responsible or liable for any consequences or financial losses such as, but not limited to, loss of business, profit, revenue, contract, data or potential savings, arising from your failure to maintain in order your account with your Line Rental provider, nor shall we be held responsible for maintenance of or any faults, failures, damages to your telephone line.

7.3 We shall not be liable for any defaults, failure, act of omission caused by third parties such as power supplier, Network Access Provider, Network Operator or their telecommunication system, their loss of revenue or receivership, nor for any claim for damages, including loss of profits, consequential or punitive damages, exemplary, incidental, indirect or special damages arising from such causes and related in any way to the Services provided.

7.4 We shall not be liable to you, or any other person claiming through you, for any costs, contribution, damages, consequential, direct or indirect economic loss whether caused by UK2Numbers, or its agent’s negligence, arising from, but not limited to, UK2Numbers’ act of omission or failure in respect of provision of Services.

7.5 We shall not be liable for any failure to carry out our responsibilities under this Agreement for reasons beyond our control including acts of God, Government, severe atmospheric conditions, emergency on major scale or any social disturbance of extreme nature such as industrial strike, riot, terrorism and war or any act or omission of any provider, such as a Network Access Provider, Network Operator or their telecommunication systems, their loss of revenue or receivership.

8 Handling of Customer Personal Data:

8.1 UK2Numbers and their Agents shall use information provided by you in relation to this Agreement in accordance with the Data Protection Act 1998 and for the following purposes: (i) to identify the Customer and their Account in our communications with them, (ii) to analyse their needs and from time to time offer to them other parts of our Services and different products which may be of interest, benefit or improvement to them and for that purpose we may use our automated scoring system which analyses data supplied by the Customer.

8.2 UK2Numbers may check your details with any of the Licensed Credit Reference and Fraud Agencies. We shall keep records of any such check and your payment records and we may share this information with any Licensed Credit Reference Agency which also may keep this data. This shall also be applied in cases of joint applications unless we are advised by either of the applicants that there is no financial association between them.

8.3 UK2Numbers shall hold data of a Customer’s location, telephone, facsimile, email communications and numbers contacted in all communications, their date, time, duration and costs. These records shall be kept as long as legally required and shall not be divulged to anyone bar (i) those organisations who are legally entitled to it and (ii) the Police in cases of suspected fraud, money laundering and any other illegal activity. In order to assist in prevention of these unlawful activities UK2Numbers may use in the operation of our Services detection technology.

8.4 UK2Numbers may monitor and record telephone and other communications with the Customers for training and quality purposes and with the aim to comply with any legal or regulatory requirement.

9 Definitions:

9.1 Account – the record of all Customer details, call data and charges due.

9.2 Act – Telecommunications Act 1984.

9.3 Agreement – Terms and Conditions inclusive of the Tariff Sheet.

9.4 Call Charges – the Charges for calls incurred by the Customer and payable to UK2Numbers.

9.5 Charges – All Charges payable to UK2Numbers in respect of Connection, Rental, Price List or provision of On-Site services.

9.6 Code of Practice – Our code of practice governing the manner in which UK2Numbers deals with provision of Services and conduct of any aspect of the relationship of the Parties in this Contract.

9.7 Commencement Date – Date upon which UK2Numbers commences provision of any Services and / or supply of equipment for which a Customer has placed an Order.

9.8 Confirmation Date – Date when UK2Numbers advises the Customer that the specified is available for use.

9.9 Contract – Application of the agreed terms between the Parties.

9.10 Customer – Any entity, be it a member of the general public, a person(s), Limited or Public Company or any other body which enters into Agreement with UK2Numbers for provision / supply of services or equipment and is indicated on the submitted Order Form as a user / subscriber.

9.11 Customer Care Centre – UK2Numbers centre where all queries, faults or other reports are directed and dealt with.

9.12 ICSTIS – The Independent Committee for the Supervision of Standards of Telephone Information Services.

9.13 Network Operator – Any licensed public telecommunication operator used by the Customer to connect telecommunication services to and from its premises and / or used by UK2Numbers to deliver the Service to the Customer.

9.14 NGN – Non-Geographic Number issued by UK2Numbers to the Customer and allocated to their Account.

9.15 OFCOM – Office of Communications, regulator for the UK Communications Industries formerly known as OFTEL. Full details about their role can be found at www.ofcom.org.uk.

9.16 On-Site Equipment – Any UK2Numbers equipment supplied to and located at Customer Premises.

9.17 Order – Placement of the Customer’s request for provision of services or supply of equipment on UK2Numbers online Order form.

9.18 Parties – UK2Numbers and any other entity defined in 9.10 above who is subject to this Contract.

9.19 Premises – Any suitable location indicated by the Customer on the appropriate Order Form where Services are to be provided.

9.20 Personal Numbering Services – Services based on number translation that enables End-Users to be called or otherwise contacted using a single Personal Telephone Number.

9.21 Personal Number – The same as 070 numbers.

9.22 Rental charges – the charges in respect of use of any Services provided by UK2Numbers, or On-Site Equipment placed at the Customer’s Premises.

9.23 Service(s) – Provision of Telephone Numbers, Connection to Telecommunications Network, Call Diverting system and any other Telecommunication Service UK2Numbers may provide pursuant to an individual Contract.

9.24 Service Test – Simple and quick dial up self-check of a purchased Number and / or Services, performed prior to publicising or advertising them for a business or personal purposes.

9.25 Tariff Sheet – The Standard UK2Numbers Schedule of Charges applicable to the Service(s) and Products provided to the Customer.

9.26 Termination Point – Destination number or e-mail address as per Customer’s choice, nominated for delivery of Services.

9.27 070 Numbers - Ranges which are allocated solely to Personal Numbering Services beginning with 070.

9.28 0800 Numbers – Range which is free of charge to a caller, calling from UK landlines.

9.29 0844, 0845, 0870, 0871, 0800, 01, 02, 03 and 070 Numbers – Non-Geographical Number Ranges (NGN)

9.30 The End User – Term used for the purpose of Personal Numbering as it relate to a person being called.

9.31 UK2Numbers – A subdivision of IM Software Limited, trading as UK2Numbers, a company incorporated in the United Kingdom, registered under number 4602389 whose Registered Office is at Po Box 219, High Street, Orpington, Kent, BR6 0NZ and includes its permitted successors, assignees, employees and agents.

9.32 UK2Numbers’ Licence – The licence granted to UK2Numbers pursuant to the Act and any radio licence granted to UK2Numbers that is relevant to this Agreement.

9.33 UK2Numbers Network – Telecommunication System operated by UK2Numbers pursuant to the UK2Numbers Licence.

9.34 User Licence - The licence issued or published by the DTI pursuant to the Act in accordance with which the User is entitled to use the Services.

9.35 User Premises Equipment – The service delivery equipment at the Premises, including, but not limited to, the User telephone system operated together with the On-Site Equipment (if any) for the purpose of obtaining the Services.

9.36 User – Subscriber to the Service, Customer as defined in 9.10 above, which reasonably appears to act within the said definition’s authority and, were relevant, their permitted assignees, employees and agents.
